$1.1M settlement just before trial for construction worker
Plaintiff was in the process of installing heating and air conditioning when walking down a staircase that collapsed, sending him 10 feet into the basement. One of the more difficult parts of the case was whether the “single family home exception” applied to the labor law of section 240 (1) for injured workers. After hard fought discovery and intense questioning of witnesses, Glenn Auletta proved the exception was applicable. He had his power point and live trial director program ready to go. Defense was forced to settle for $1.1 million.
