WHAT DOES IT COST TO HIRE A PERSONAL INJURY LAWYER?

Posted By Gruenberg Kelly Della || 14-Nov-2018
Many personal injury attorneys will nickel and dime you on the front end and work lots of hidden costs into your legal fees, but others charge you based on a contingency fee arrangement.

How Do Contingency Fees Work?
When you hire an attorney who works on a contingency fee basis, you won’t pay any legal fees until and unless they win your case and secure compensation on your behalf in the form of a settlement or verdict. If your lawyer is successful, their payment will come out of your compensation package, and it is usually around 30 percent of the total amount you receive in your case. However, more complex, risky, or challenging cases may require you to pay a larger percentage or your recovery, and simpler cases may require you to pay less than 30 percent.

Costs of Personal Injury Litigation
In addition to contingency fees, there are other costs associated with litigating your personal injury case. You may not have to pay any of these until your case is resolved, but they will be factored into your total costs.

Normal litigation costs include:

    • Cost of filing a personal injury complaint (This costs approximately $400 if you file in a federal court.)
    • Costs of discovery and depositions (These require bringing in a court reporter and purchasing a transcript of the deposition, which can cost up to $1,000.)
  • Cost of bringing in expert witnesses (These may charge as much as or more than your attorney’s contingency fees and typically charge several thousand dollars to look over your case and provide testimony during trial.)
  • Cost of compiling evidence and handling documents (This involves obtaining public documents, medical documents, and other important pieces of evidence, which can cost hundreds of dollars. Mailing, copying, and handling documents can cost several hundred more.)
